Effective Date: June 4, 2026
These Terms and Conditions (“Terms”) govern your access to and use of the website, landing pages, forms, booking flows, communications, services, content, and related online features provided by AgencyBooked (“AgencyBooked,” “we,” “us,” or “our”).
By accessing our website, submitting a form, booking a call, purchasing services, communicating with us, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our website or services.
Important: These Terms apply to all visitors, leads, prospects, clients, customers, and users of AgencyBooked services.
AgencyBooked provides business, marketing, sales, booking, consulting, automation, lead generation, and related agency services. The exact scope of any paid service may be described on our website, in a proposal, order form, invoice, checkout page, email confirmation, written agreement, or other written communication from us.
We may update, modify, suspend, or discontinue any part of our website or services at any time, with or without notice, unless a separate written agreement states otherwise.
You must be at least 18 years old and have the legal authority to enter into these Terms. If you use our services on behalf of a company, organization, agency, or other entity, you represent that you have authority to bind that entity to these Terms.
You agree to use our website and services only for lawful purposes and in accordance with these Terms. You must not:
When you submit information to AgencyBooked, you represent that the information is accurate, complete, and not misleading. You are responsible for keeping your contact, billing, business, and account-related information accurate and up to date.
You are responsible for any consequences resulting from inaccurate, incomplete, or outdated information that you provide.
If you book a call, consultation, appointment, or meeting with us, you agree to provide accurate scheduling information and attend at the scheduled time.
We may cancel, reschedule, or decline any call, meeting, consultation, or booking at our discretion. A booked call does not guarantee that we will provide services, accept you as a client, or enter into any business relationship with you.
The services we provide may include marketing, outreach, booking support, consulting, systems, automation, strategy, sales support, lead generation, or other business services.
Unless expressly stated in a written agreement signed or confirmed by AgencyBooked, all services are provided on a commercially reasonable efforts basis. We do not guarantee any specific business outcome, revenue amount, profit level, number of leads, number of bookings, conversion rate, return on investment, or other result.
Any timelines, projections, estimates, or expected results are provided for planning purposes only and are not guarantees.
You understand and agree that business, marketing, sales, and lead generation outcomes depend on many factors outside our control, including your offer, market, pricing, reputation, sales process, follow-up, competition, advertising conditions, platform rules, customer demand, and general economic conditions.
AgencyBooked does not promise or guarantee that you will obtain any specific number of clients, appointments, leads, customers, sales, revenue, profit, or other business results.
If you purchase services from AgencyBooked, you agree to pay all fees, charges, and applicable taxes described at checkout, in an invoice, proposal, order form, written agreement, or other written communication from us.
Payments must be made using the payment method we make available. You authorize us and our payment processors to charge your selected payment method for amounts due.
Unless otherwise stated in writing, fees are due in advance and must be paid on time. We may pause, suspend, or terminate services if payment is late, declined, disputed, reversed, or not received.
If a service is sold on a subscription, retainer, or recurring billing basis, you authorize recurring charges until the subscription or service is canceled in accordance with the applicable cancellation terms.
Unless otherwise stated in writing, cancellation stops future billing but does not automatically create a refund for amounts already paid or amounts already due.
Unless a separate written refund policy or agreement expressly states otherwise, payments made to AgencyBooked are non-refundable to the fullest extent permitted by law.
We may consider refund requests at our sole discretion, but we are not required to issue a refund unless required by applicable law or expressly agreed in writing.
If you cancel, delay, fail to provide required materials, miss scheduled calls, or do not cooperate with the service process, you remain responsible for all fees due.
If you believe there is an issue with a charge, you agree to contact us first at support@agencybooked.com so we can attempt to resolve the issue.
Unauthorized or improper chargebacks may result in suspension or termination of services, collection efforts, recovery of fees, and any other remedies available under applicable law.
To receive services effectively, you may be required to provide information, approvals, access, materials, feedback, assets, login credentials, brand guidelines, offers, pricing, calendars, CRM details, or other cooperation.
You are responsible for:
Delays caused by your failure to cooperate may affect timelines, performance, and deliverables. We are not responsible for delays or issues caused by missing, inaccurate, delayed, or incomplete information from you.
Our services may involve third-party platforms, tools, software, websites, applications, advertising platforms, scheduling tools, CRM systems, payment processors, email platforms, hosting providers, or communication services.
We do not control third-party platforms and are not responsible for their acts, omissions, policies, downtime, errors, pricing changes, account restrictions, suspensions, algorithm changes, data practices, or service interruptions.
Your use of third-party platforms may be subject to their own terms, policies, fees, and privacy practices.
All content, branding, designs, copy, graphics, videos, frameworks, templates, strategies, systems, processes, workflows, website content, materials, and other intellectual property provided by AgencyBooked are owned by AgencyBooked or its licensors, unless otherwise stated in writing.
You may not copy, reproduce, modify, distribute, resell, publish, display, transfer, reverse engineer, or create derivative works from our intellectual property without our prior written permission.
Subject to your full payment and compliance with these Terms, we may grant you a limited, non-exclusive, non-transferable license to use final deliverables created specifically for you for your internal business purposes.
You retain ownership of materials, content, trademarks, logos, data, and business information that you provide to us.
By providing materials to AgencyBooked, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, host, display, transmit, and process those materials as necessary to provide services, communicate with you, fulfill our obligations, and operate our business.
You represent that you have all rights and permissions necessary to provide those materials to us and allow us to use them.
If you provide feedback, reviews, testimonials, comments, or suggestions, you grant AgencyBooked the right to use, display, reproduce, publish, and distribute that feedback for business, marketing, promotional, and service improvement purposes, unless you expressly request otherwise in writing.
We may use your business name, public results, public-facing brand assets, and general description of services performed as part of our portfolio, case studies, or marketing materials, unless a separate written agreement states otherwise.
During the course of services, either party may receive confidential or non-public information from the other party. Each party agrees to use reasonable care to protect confidential information and not disclose it to unauthorized third parties, except as needed to provide services, operate the business, comply with law, or with consent.
Confidential information does not include information that is public, independently developed, already known, lawfully received from another source, or required to be disclosed by law.
Our collection and use of personal information is described in our Privacy Policy. By using our website or services, you also agree to our Privacy Policy.
You can view our Privacy Policy here: Privacy Policy.
You agree that we may communicate with you electronically, including by email, website forms, booking tools, text message, messaging platforms, invoices, or other digital communication methods.
You agree that electronic communications satisfy any legal requirement that communications be in writing, to the fullest extent permitted by law.
Our website and services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
To the fullest extent permitted by law, AgencyBooked disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
We do not warrant that the website or services will be uninterrupted, secure, error-free, free of harmful components, or that any defects will be corrected.
To the fullest extent permitted by law, AgencyBooked and its owners, officers, directors, employees, contractors, agents, affiliates, service providers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, loss of goodwill, data loss, or business interruption.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the website, or services will not exceed the amount you paid to AgencyBooked for the specific service giving rise to the claim during the three months before the event giving rise to liability, or one hundred U.S. dollars ($100), whichever is greater.

We may suspend or terminate your access to the website or services at any time if we believe you violated these Terms, failed to pay amounts due, created risk or liability for us, misused our services, or acted in a way that may harm AgencyBooked, our clients, our service providers, or others.
Termination does not affect any payment obligations, intellectual property rights, confidentiality obligations, disclaimers, limitations of liability, indemnification obligations, or other provisions that should reasonably survive termination.
AgencyBooked will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, internet or hosting failures, cyberattacks, labor disputes, war, terrorism, civil unrest, government action, power outages, platform outages, supplier failures, epidemics, pandemics, or other events outside our control.
These Terms are governed by the laws applicable to AgencyBooked’s principal place of business, without regard to conflict-of-law principles, unless applicable law requires otherwise.
If a dispute cannot be resolved informally, the parties agree to resolve the dispute in a court or forum with proper jurisdiction over AgencyBooked, unless applicable law requires a different venue.
Before filing any legal claim, you agree to first contact us at support@agencybooked.com and attempt to resolve the dispute informally. You agree to provide a written description of the dispute, the relief requested, and any relevant supporting information.
The parties agree to make a good-faith effort to resolve any dispute informally before pursuing formal legal action.
To the fullest extent permitted by law, you and AgencyBooked agree that any dispute will be brought only on an individual basis and not as a class action, collective action, representative action, private attorney general action, or consolidated proceeding.
Any information provided through our website or services is for general business and informational purposes only. AgencyBooked does not provide legal, financial, accounting, investment, tax, or regulated professional advice unless expressly agreed in a separate written agreement.

Your continued use of the website or services after updated Terms are posted means you accept the updated Terms.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified or interpreted to the maximum extent permitted by law to achieve its intended purpose.
These Terms, together with our Privacy Policy and any applicable written agreement, order form, invoice, proposal, or service-specific terms, constitute the entire agreement between you and AgencyBooked regarding your use of the website and services.
If there is a conflict between these Terms and a separate written agreement signed or expressly confirmed by AgencyBooked, the separate written agreement will control for that specific service.
